Terms of Service

Effective September 2026.

These terms apply to sweathousegym.com and to anything you buy through it. Sweat House Gym ("Sweat House," "we") operates the gym at 300 First Ave W, Kalispell, MT 59901. Using the site means you accept what is below. Anything unclear, ask at the desk or call (406) 752-2438, and we will give you a straight answer.

Your membership agreement comes first

When you join you agree to a membership agreement and a liability waiver, either at the front desk or at checkout if you join online. Those documents govern your membership, and where anything on this page differs from what you agreed to, what you agreed to wins. These terms cover the website and the purchase, not the membership itself.

Buying online

Memberships and passes bought on this site are processed by Mindbody, our scheduling and payment platform. Your card details go to Mindbody and its payment processor, never to us. Their terms apply to the transaction alongside ours, and their privacy practices are their own.

Prices shown on this site are the current ones. We may change them, and a price change never applies retroactively to a term you have already paid for. If a price is displayed in error, we will tell you before anything is charged rather than hold you to a number that was wrong.

Membership terms

Which one you pick decides what you owe:

  • 12-month prepaid. Twelve months paid up front, at the best rate we offer.
  • 12-month contract. A twelve-month membership billed monthly. The twelve months are a commitment; the payments are spread across them.
  • No commitment. No term. Stop whenever you like.

Monthly memberships bill automatically on the same day each month to the card on file. Keeping that card current is on you. If a payment fails we will contact you before anything else happens.

There is no initiation fee and no annual fee on any of them.

Two charges worth knowing about before they happen: a returned or declined payment costs $15 per transaction, and a replacement key tag is $10. A balance left unpaid for thirty days may carry a service charge and pause your access; after sixty days it may go to collection.

Freezing and canceling

You can freeze a membership for up to 60 days a year at no charge. Ask at the desk at least 10 days before your next billing date. Billing pauses for the freeze and your term extends by the same number of days, so a freeze costs you time rather than money.

Month-to-month memberships can be canceled at any time, effective at the end of the current billing month. Tell us at least 15 days before your next billing date to stop that payment; later than that and it goes through.

Term memberships run to the end of their term. If you need to end one early for a reason other than the ones below, there is an early termination charge of half the value of the months you have not used. On a membership billed monthly that is half the dues left in the term, and it is due when you cancel. On a membership paid up front it works the other way round: we refund the unused months less that half. Come and talk to us first, though; things change, and a freeze or a transfer often solves it better than a buyout does.

These rights are ours to give rather than the state's to require, and we give them: seven days to change your mind after signing, with everything back, and a way out at any point if a doctor says you can't train for more than six months or we close. They're written into your membership agreement and we're not going to argue about them.

Passes

Day, three-day, week and one-month passes start on first use and run consecutively from there, not by visit. Drop-in class rates cover one class. Passes are not refundable and cannot be transferred, but whatever you spend on one comes off your membership if you join within 30 days of the pass running out, which makes trying the place out effectively free if you do. The credit applies once and it does not turn into cash.

Personal training

Training packages are bought as a block of sessions and expire twelve months from purchase. Sessions are scheduled with your trainer directly. Give us reasonable notice if you cannot make one so someone else can use the slot; a session missed without notice may be counted as used. Packages are not transferable between people.

Guests

Bring whoever you like. Everyone who trains needs their own pass or membership, so a guest picks up a day pass at the desk, and everyone signs a waiver and checks in before their first visit. Under-18s need an adult with them. Tell us ahead and we'll have somebody show them around.

Childcare

Childcare is available during posted hours for members. A parent or guardian must remain in the building for the whole time a child is in the room. That is not a preference, it is the condition the service runs under, and staff will come and find you if it is not being met.

Using the gym

Your keytag is yours. Do not lend it, and do not let anyone in behind you during unstaffed hours, including people you know. Everyone who trains here has an agreement and a waiver on file, and letting someone in around that puts both of you at risk.

Beyond that the expectations are the ordinary ones: re-rack your weights, wipe down equipment, share when it is busy, follow posted rules and staff direction, and treat other members and staff decently. We can end a membership for conduct that makes the gym worse for other people, and we will refund the unused portion if we do.

Risk

Training is physical activity and carries risk of injury. You are responsible for exercising within your own limits and for telling us about conditions that affect what you should be doing, particularly before personal training or a class. Talk to a doctor before starting if you have any reason to. The waiver you sign covers this in full.

We are not responsible for personal property lost, damaged or stolen on the premises. Lockers are for use during your visit; anything left overnight may be cleared.

This website

The text, photography, logos and design on this site belong to Sweat House Gym. You are welcome to link to it and to share it. Copying it for a commercial purpose is not.

We keep the schedule, prices and hours here accurate and update them when they change, but the front desk is the authority if the two ever disagree. Class times in particular move.

Limits

The site is provided as it is. We do not promise it will be available without interruption, and we are not liable for indirect or consequential losses arising from using it. Nothing here limits any liability that cannot be limited under Montana law, including for death or personal injury caused by negligence.

Governing law

These terms are governed by the laws of the State of Montana, and any dispute belongs in the state or federal courts serving Flathead County.

Changes

If these terms change materially we will post the update here and note it at the front desk before it takes effect. Continuing to use the site after that means the new version applies.
